The attorneys at the Law
Offices of Lee & Bardavid also practice litigation in the areas of personal
injury claims and wrongful death cases.
These categories typically involve automobile accidents, motorcycle
accidents, and a wide variety of other incidents which lead to the injury or
death of an individual. We believe that
the human body is one's temple, and therefore we are dedicated to assuring that
all of your rights are protected if you are injured by the recklessness or
negligence of another person.
In the United States of America, the law of
negligence is founded on reasonable conduct or reasonable care under all the
circumstances of a particular case and rests on the duty of every person to
exercise due care in his or her conduct toward others from which injury may
result. Negligence is usually characterized as thoughtlessness or neglect on
the part of an individual while going about their daily activities. On the other hand, recklessness or malice is characterized
as a conscious disregard for the rights and safety of others. Depending on the conduct of the wrongful
party, the law will look to compensate the victim in different ways. For example, if one acts negligently and due
to this negligence you are hurt, the law will try to make you whole again. In other words, the law will look to put the
injured person back in the state that person was in before the accident--it
looks to keep the status quo. However,
if the wrongful person was malicious in their actions, the law not only looks to
put the victim back in the position they were in prior to the accident, but
also looks to punish the wrongful individual and deter others from engaging in
the same type of conduct by awarding punitive damages to the victim. To have
the desired effect, the punitive damages must have a meaningful impact on the
wrongdoer. Consequently, the more wealthy the wrongdoer, the greater the amount
of punitive damages assessed.
Accordingly, an individual with a million dollars will be forced to pay
more than an individual with five thousand dollars.
Lastly, while every
injury is very important, serious injuries raise additional legal issues. Such injuries as amputation, loss of sight
and hearing, spinal injuries, closed head injuries, brain injuries and damage,
paralysis, and other such life altering injuries raise important issues such as
future medical care, compensation for pain and suffering as appropriate, and
loss of companionship. The severity of
the injury will dictate the amount of compensation needed to put that person
whole again--to reach the status quo.
Therefore, our lawyers
are dedicated to assuring that each individual is compensated as the law dictates. We will do everything in our power to assure
that your rights are protected. So, if
you believe that you may have a personal injury case, please contact us at any
time, day or night. As we will be
working on a contingency fee, you will not have to pay us; we get paid only
when your case is resolved and you receive compensation.
